Lesson 008

(Baabu Qadaa` al-Haajah)

[Answering the Call of Nature]

The scholars say that there are adaab (mannerisms) one has to observe before, during and after answering the call of nature.

يستحب لمن أراد دخول الخلاء أن يقول: بسم الله، أعوذ بالله من الخبث والخبائث، ومن الرجس النجس الشيطان الرجيم، 31

Imaam ibn Qudaamah, rahimahullaah, wrote, “It is recommended for one who enters the toilet/bathroom to say: (I enter) in the Name Allaah, I seek refuge with Allaah from al-Khubth (evil) and al-Khabaa`ith (the shayaateen), and from ar-Rijs (the foul one), an-Najis (the filthy one), the accursed Shaytaan”.

In another narration, the word al-Khubth is replaced with ‘al-Khubuthi’ (male jinn) in which case al-Khabaa`ith refers to the female jinn. This is also a valid supplication. The latter portion of the du’aa` mentioned by Imaam ibn Qudaamah, i.e. “from ar-Rijs, an-Najis, the accursed Shaytaan” is not authentic.

  • Utensils of Gold and Silver

The Dhaahireeyyah, Ibn ‘Abdu`l-Barr, an-Nawaawee, ibn Qudaamah, rahimahumAllaah, they all said that the opinion that the utensils of gold and silver may not be used for anything (including doing wudoo’ etc.) was the majority opinion, and some of them (such as Ibn ‘Abdu`l-Barr) said it is based on Ijmaa’ before another scholar came and differed with them (Dawood – ?).

Thus, perhaps it is safer to follow the opinion that it is not permissible to use utensils of gold and silver for anything. Allaah knows best.

If the utensils are plated with gold and silver, then they take the same ruling as that of utensils made of gold and silver, unless they are soldered due to a need.

(Baabu`l-Aaneeyah)

The majority of the scholars considered human blood to be Najas, and a minority amongst the scholars considered human blood to be taahir (with the exception of menstrual blood).

Say (O Muhammad): “I find not in that which has been inspired to me anything forbidden to be eaten by one who wishes to eat it, unless it be Maytatah (a dead animal) or blood poured forth (by slaughtering or the like), or the flesh of swine (pork, etc.) for that surely is impure, or impious (unlawful) meat (of an animal) which is slaughtered as a sacrifice for others than Allâh (or has been slaughtered for idols, etc., or on which Allâh’s Name has not been mentioned while slaughtering). But whosoever is forced by necessity without wilful disobedience, nor transgressing due limits, (for him) certainly, your Lord is Oft-Forgiving, Most Merciful.”
[Soorat al-An’aam (006:145)]

Does this blood not tell us that flowing blood is haraam and impure?

  • A Detailed Analysis of Purification from a Dog’s Saliva

The Hanaabilah categorized impurities into three categories, from which one of them is:

1. Najaasah Mughalladah – Severe, because of the way in which you have to purify yourself from it. The saliva of the dog falls under this category.

The Hanaabilah then made Qiyaas on this issue and said that all of the dog is also impure. They further stated that the swine is also impure as it is worse than the dog and if the dog is considered by the Shar’eeyyah to have this kind of severe ruling than the swine should also have a ruling similar to it. Although this opinion is perhaps weaker and only restricted to the saliva of the dog because the saliva was specifically mentioned in the hadeeth and the Prophet sallAllaahu ‘alayhi wa sallam did not make a general statement.

Purifying from Various Najaasaat

Imaam ibn Qudaamah rahimahullaah called this chapter “How to Purify the Impurities of the Dog and the Swine.”

وتغسل نجاسة الكلب والخنزير سبعاً إحداهن بالتراب، .13

Imaam ibn Qudaamah wrote, “The filth of the dog and the swine should be cleaned seven times, six times with water and one time with dust.”

Narrated Aboo Hurayrah radiAllaahu ‘anhu: Allaah’s Messenger sallAllaahu ‘alayhi wa sallam said: “The purification of the utensil belonging to one of you, if it has been licked by a dog, is to wash it seven times, using surface soil for the first cleaning.”
[Muslim]

In another narration of Muslim, he has “He should pour out the contents”. At-Tirmidhee also has “…using surface soil for first or last (cleaning)”.

There is another Hadeeth concerning this matter, which states that it should be washed with soil the eighth time. Both of these Hadeeth are Saheeh (authentic), but they seem to contradict.

Categories of Water

According to the madh-hab of Imaam Ahmed, rahimahullaah, there are three categories of water:

1. Tahoor – Pure and may be used for purification.
2. Taahir – Pure (its self) but cannot be used for purification.
3. Najas – Impure and cannot be used for purification.

When does water become pure but not purifying (i.e. Taahir)?

[Physical and Ritual Purity]

Tahaarah (Purification) is the most important prerequisite to Salaah, which is the reason (alongside some others) for starting with this topic.

Imaam ibn Qudaamah, rahimahullaah, titled this chapter “Baabu `Ahkaamul Mi`aah”, “The Chapter Concerning Rulings of Water”.

Before one wants to pray they need to be in a state of wudoo`, and wudoo` requires water.

Water has different rulings regarding it. Thus, we start by defining the rulings of water.
